TERMS OF PARTICIPATION FOR THE “AVANTGARDE ACOUSTIC HIGH END MUNICH 2024 SWEEPSTAKES”

1 Organiser

  1. The sweepstakes is organised by Avantgarde Acoustic Lautsprechersysteme GmbH, Nibelungenstra├če 349, 64686 Lautertal (hereinafter referred to as the organiser).
  2. It should be noted that this competition is not in any way connected to any social media provider on which it may be publicised. Furthermore, the sweepstakes is in no way associated with the High End Society or High End Munich and is in no way supported, accompanied or controlled by the High End Society. The recipient of the information is the organiser, not High End Society Any questions, comments or complaints should therefore be addressed to the organisers of the competition, not to the High End Society. Participation does not give rise to any claims against the High End Society.

2 Persons authorised to participate

  1. Any natural person over the age of 18 is eligible for entry.
  2. Only one specific natural person may enter at any one time. Legal entities are not eligible.
  3. Employees, authorised representatives, legal successors and agents are excluded from participation.
  4. Participation via automated procedures (e.g. via competition clubs or competition service providers) or multiple participations, for example under a pseudonym or other e-mail addresses, is not permitted and will result in exclusion from the sweepstakes:

3 Participation

  1. The participation takes place exclusively via the form https://forms.gle/F8mqRZnLPVXWsHUv9 by providing the data to be entered and confirming the participation in the form.
  2. These data (age of majority, first name, surname, e-mail address) must be complete and correct.
  3. Participation does not require the purchase of goods or services and is free.
  4. Providing feedback in no way affects the chances of winning.
  5. The entrant is responsible for any changes to this information, particularly the email address.
  6. The conditions for participation must be met for the duration of the competition and must be sent to the organiser by the means offered. Participation by any other means than the one offered for participation (e.g. other e-mail address of the Organising Company) is excluded and will not be considered. Applications for participation submitted before or after this date will not be considered.

4 Duration of the competition

  1. The competition begins on 09.05.2024 at 8:00 am; the closing date for entries is 19.05.2024 at 11:59 pm (UTC = CEST +02:00 hours).

5 Prizes

  1. 5 x 1 prize package consisting of the 3D print of a TRIO G3 and a G3 logo can be won. The prize will be sent by post.
  2. Prizes are not transferable. The Promoter is released from all obligations upon delivery of the prize. The Promoter is only liable for legal and material defects in the event of intent or gross negligence.
  3. Only one prize may be awarded per entrant.
  4. A cash payment of the prize value or an exchange of the prize is not possible.
  5. The prize cannot be transferred or redeemed at any other time.

6 Determining and informing the winners / claiming the prize

  1. The winners will be selected at random after the closing date for entries and no later than 31 May 2024.
  2. Once the winners have been drawn, they will be notified immediately by email and asked to send their address to the email address provided.
  3. The winners will have five working days from receipt of the email to claim their prize and provide a delivery address. If this is not done within five working days, the prize will be forfeited and a new winner will be selected. The same applies if a winner renounces the prize by telephone, in writing or in any other way.
  4. The announcement of the winners is without any guarantee.

7 Premature termination, exclusion

  1. The organising company reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. The organising company will exercise this right in particular if, for technical or legal reasons, the proper conduct of the competition cannot be guaranteed. In such a case, the participants have no claim against the organiser.
  2. If such a termination was caused by the behaviour of a participant, the organiser may demand compensation from this person for the damage incurred.
  3. The organiser reserves the right to exclude participants from taking part in the competition, for example in the event of violations of the conditions of participation.
  4. The organiser reserves the right to change the conditions of participation or to extend or limit the time frame or to vary the content of the prizes, provided there are objective reasons for doing so and the change is appropriate. The organiser will announce any new conditions on avantgarde-acoustic.de/en/terms-of-participation.

8 Liability

  1. The Organiser’s liability is excluded to the fullest extent permitted by law.

9 Data protection

  1. The personal data collected and processed by us will be used primarily for the purposes of organising the competition and documenting its proper conduct, for statistical purposes and for the further development and improvement of similar campaigns and, with the consent of the participant, for sending a newsletter. In doing so, we will comply with all applicable German data protection laws.
  2. The personal data of participants will only be stored for the duration of the competition, the data of winners for verification purposes until expiry of the statutory retention period. The legal basis for data processing is Art. 6 par. 1 a), as far as statistical purposes and the further development/improvement of comparable campaigns are concerned, otherwise Art. 6 para. 1 b) and c) GDPR.
  3. For this purpose, all names and email addresses of participants will be collected and stored for the purpose of determining the winners. Address data will only be collected from the winners at a later stage and will only be used to send the prize.
  4. The organiser is entitled to transfer the personal data to third parties in order to enable the delivery of the prize.
  5. The participant has a right to information, correction, deletion, restriction of processing, data portability and objection (Art. 15-21 GDPR), if necessary to revoke consent given (Art. 7 GDPR) and to lodge a complaint with a supervisory authority (Art. 77 GDPR). 10 Complaints and legal recourse

  1. These Conditions of Participation and the entire legal relationship between the participants and the organiser shall be governed exclusively by the laws of the Federal Republic of Germany. Should any provision of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.
  2. Incomplete or invalid provisions shall be supplemented or replaced in such a way that another suitable provision is found which comes as close as possible to the economic purpose of the invalid or incomplete provision.
  3. Legal recourse is excluded. There is no enforceable claim to payment of the prizes.
